Dzień Flagi ustanowił Sejm 20 lutego 2004 roku ustawą o zmianie ustawy o godle, barwach i hymnie Rzeczypospolitej Polskiej, którą Prezydent RP podpisał 16 marca 2004 roku.
Ustawa określa, że barwami Rzeczypospolitej Polskiej są kolory biały oraz czerwony. Na flagach układa się je w dwóch poziomych, równoległych pasach tej samej szerokości. Górny pas jest koloru białego, a dolny koloru czerwonego.
Najczęściej w tym dniu ozdabia się budynki flagami.
